This contract is concluded under this covenant signed by both of us who are parties thereto by our conceal and agreement in the form stated hereinabove in accordance with the following conditions:
CONDITIONS:
1) The lessee has received the leased property free of any defects. The doors, windows, glass, locks and keys, wash basins, taps and sanitary waters therefore are completed. All these things and the accessories thereof are free of any defects or failure. The lessee shall undertake to deliver same at the end of lease period in the same condition as received.
2) The lessee shall, upon expiry of the contract period and if such contract is not renewed as stated herein, taken written receipt from the lesser pointing out that the lesser has received the leased property and its annexes in good condition. In case the lessee vacates the leased property at the end of the specified period after giving, a three month notice to the lesser or upon the end of the year during which the contract is renewed hereunder without obtaining a receipt, the lesser may, if he finds a defect in the leased property, destruction in the annexes or a failure wholly or partly therein, repair same and shall have recourse in respect of the relative expenses incurred to the lessee. The lesser shall be creditable to with regard to his claim about such defect, destruction or failure and shall be reimbursed for what he spent. The lesser shall not be asked to give any evidence and his claim shall be accepted without oath. The lessee further shall, when the period of contract expires and he does not wish to renew it, give to the lesser a three month notice in writing at least, otherwise he shall be considered, if the lesser wants so, as lessee of the property for another year.
3) The lessee shall have no right to lease the property or a part thereof to a third party, nor shall he have the right to involve a partner with him in the lease of the property or abandon same wholly or in part without the consent in writing of the lesser.
4) The lessee may not make any changes in the property such as eliminating, construction, opening of windows, construction of a garret, alteration of windows, taps or others except with the consent of the lesser.
5) All failure and defects which may occur to the property such as breakdown in the sewerage or piping or any other facility annexed to the property shall be repaired by the lessee. The lessee shall not demand any indemnity from the lesser in this respect. He shall not also demand the lesser to pay any indemnity or damages whatsoever due to any failure or breakdown occurring to the public utilities annexed in the building.
6) If the lessee refrains from, or is in arrears with paying any installment on its maturity date, all other installments shall become payable at once. In this case, the lesser shall have the right and option to cancel this contract and receive the leased property even if the period of the lease does not expire. He shall further seize the property and lease it to a third party for the rental value as he may deem fit provided that he shall have recourse to the lesser with respect to any difference between the two values in case the second value is less that the first one. The lesser shall in such case be creditable without oath.
7) In case either of the matters set forth in paragraph 5 and 6 hereinabove take place the lesser may also lay hands on the lessee’s property (Personal effects) available in the leased house, sell it for the price he may deem fit and take his entitlements out of the proceeds. The lessee may not have any objections against the lesser as this is one of his securities toward the lesser.
8) The lesser may build upper floors on the leased property or near it. He may make all the repairs he may wish in the property and its annexes or in the vicinity thereof regardless of the time such repairs take whether during this period of the lease or the period to be extended for another lease, be this extension by agreement of both parties herein, by force of the law or this contract as mentioned in paragraph 2 herein or in any other case, in all these cases the lessee shall have no right to claim damages or reduction of the rented value.
9) All that is done by the lessee such as rearrangements, repairs, porcelain laying and the like as well as all stable things shall be paid by him. Upon his departure, the lesser may either take these works as they are free of charge or request restoration of the house to its original conditions, in which case the restoration expenses whatsoever shall be charged to the lessee. The lesser may restore the house to its original condition at the expense of the lessee without giving him any notice. The lesser shall be creditable without oath in respect of the expenses he incurred.
10) The lessee shall not use the leases property for any purpose except the purpose for which he rented it, neither shall he use it in such a way as may be in violation of religion, law, the order of the country and the public morals.
11) In case the there are several lessees of this contract, they shall be jointly and severally bound by all its provisions and obligations. Any notice to any of them shall be considered as notice to all of them. Every one of them shall also be liable and responsible for implementing all the obligations in full consequent upon himself and all the other partners bound with him hereunder being the renting leans considered as one person. Such shall be the case when the lessee is a company or incorporated person. The person / persons signing on the behalf of the company or corporation (the incorporated person) shall be jointly and severally responsible for the obligations of the lessee hereunder throughout the period of this contract or any other period to be renewed.
12) Except in the cases provided for by the law there shall be no need for the exchange of any notices or warnings between the parties hereto.
13) With effect from now, the lessee shall forfeit the claim of false statement herein wholly or in part as well as any relative bills of exchange, cheques and instruments made for the settlement of the rental value prescribed hereunder. The lessee shall further forfeit the right to request the lesser to take the oath with respect to the contents of the contract as well as the instruments based on it whatever kind wholly or in part.
14) The lessee shall be liable to pay the entire price of water and electricity consumed, tax of education, and all taxes and fees imposed by the law.
15) The lessee shall not allow any protrusion of show windows or decoration outside the space of the leased property.
Additional Conditions:
This agreement is reached upon these conditions and both parties herein express acceptance thereof.
